The Hirer agrees to pay Justbrides the Hire Fees for the Equipment at the rates specified on the website or in the Equipment Hire Invoice from the date and time the Equipment is delivered to the date and time the Equipment is picked-up by Justbrides. The Hirer pays for the entire time the Equipment is hired out not for the time the Equipment is used. The minimum hire period is 1 day (24 hours).
The Hirer is required to pay a bond prior to being able to Hire Equipment either through the website or directly with Justbrides. The bond may take the form of cash, credit card or EFTPOS. The bond may be used by Justbrides as payment for lost, stolen or damaged equipment or any other charges. The Hirers liability for any lost, stolen or damaged equipment will be for the total cost of the equipment and is not limited to the bond amount. If the Equipment is collected without damage by Justbrides then a full refund of the deposit/bond to the Hirer will be made via Bank Transfer.
The Hirer agrees to pay Justbrides all and any appropriate taxes, stamp duty and government charges in addition to the Hire Fees. If a goods and services tax or similar value added tax ("GST") is levied in respect of any taxable supply made under or in connection with this Contract the amount payable for that supply will be increased by the rate of GST and shall reflect any reduction in or abolition of any existing taxes.
The Hirer is responsible for procuring their own insurance for the full value of the Equipment in the case of loss, theft or damage during the hire period. No insurance is offered by Justbrides. Clients are 100% responsible for complete replacement/repair costs of damage, lost or stolen Hire Equipment.
The Hirer shall use the equipment for purpose(s) for which is designed for and agreed to at the time of hire. If the equipment is used in a negligent, unskilful or improper manner, or in a manner other than that for which the Equipment was intended or constructed (or if the Hirer leaves the Equipment unattended), and the equipment is thereby lost or damaged, then the Hirer shall be liable to Justbrides for any such loss or damage. The Hirer understands that all equipment will be tested and checked once picked-up by Justbrides and The Hirer has the right to be there while the equipment is being checked. Justbrides should be notified prior to pick-up if you wish us to inspect the equipment in front of you. If any equipment is not working or damaged the Hirer will be liable for the full replacement cost or repair cost, whichever is deemed fit by Justbrides.
The Hirer agrees for Justbrides to deliver, install and setup the hire equipment prior to ceremonies and functions. The Hirer shall provide Justbrides with keys, passes, access and/or necessary permissions (either from owners or third-party venues) to enter the premises for setup. All setup instruction should be provided to Justbrides prior to the event so the Hirer need not be present for installation purposes.
All fees and charges payable under this Contract must be paid in advance and the Hirer agrees to provide full contact details, proof of address and credit card details. The Hirer agrees to any additional costs and payment in full within credit terms for any additional freight and delivery costs incurred and any additional Hire Fees and other charges incurred as a result of late return Equipment.
The Equipment shall at all times remain the property of Justbrides. The Hirer agrees not to sell, transfer license, loan, hire or give the Equipment to any one or to part with or share possession of the Equipment or do anything which may affect Justbrides interest in the Equipment. If the Equipment is hired on to a third party by the Hirer - it remains the responsibility of the Hirer for the condition and return of equipment.
In the event of a breakdown of the equipment during the hire period, the Hirer shall report the Equipment to Justbrides immediately and shall on no account repair or attempt to repair the Equipment without the prior consent of Justbrides. Justbrides should be notified immediately by phone/SMS in the case of a breakdown on the emergency number 0402518110.
Where permitted by "Australian Consumer Law Schedule of the Competition and Consumer Act" ('The Australian Consumer Law') Justbrides shall not be liable to the Hirer or any third party in respect of any loss or damage however caused arising directly or indirectly from the hire of the Equipment. Justbrides liability if any is limited to a refund of the Hire Fees charged for such Equipment. All other excludable warranties whether express or implied are excluded. The Hirer indemnifies or holds harmless Justbrides from all and any liability, losses, damage, claims, demands and expenses of any kind however caused arising directly or indirectly from this Equipment Hire Contract.
A $50 admin fee will apply to all bookings that are cancelled more than 14 days prior to the hire date. Any bookings cancelled within 14 days of the hire date will incur 50% of the total hire charges or $50, whichever is higher. Bookings cancelled within 24 hours of the hire date or no-shows will be charged 100% of the hire charges. If the Equipment is not available to be collected by Justbrides on the due date then hire charges will apply based on the normal daily hire rate for those items. If Equipment is not returned within 3 business days of the return date Justbrides at their discretion may charge the amount for the cost of the equipment.
The Equipment Hire Contract may be terminated immediately by Justbrides if the Hirer breaches any term of this Contract.
Where equipment is supplied by Justbrides on a "free of charge" basis, these terms and conditions still apply.
